Description:  A Continuing Legal Education (CLE) workshop for Attorneys and Paralegals on TBA – previously planned seminar cancelled.
Hostess, Attorney Divina Westerfield, Esq. of and, will lecture during the working-lunch hour on issues related to mortgage notes.

Seminar participants will be provided with a notebook packed with sample pleadings, motions, memoranda of law, case law, and forms including client intake and screening forms and discovery forms as well.

Topics covered include:

Case screening and identifying preliminary issues in foreclosure documents;
Pre-litigation inquiries (including 1641(f)(2) and document requests)
MERS (assignments, substitutions of trustee, limitations on MERS including case law)
Securitization issues (including loan delivery limitations, toxic assignments, credit enhancements and insurances)
Initial pleadings (Answers and Counterclaims in judicial cases; Complaints, Temporary Restraining Orders, and Preliminary Injunctions in nonjudicial cases)
Filing and defending dispositive motions (to dismiss and for summary judgment)
Forbearance Agreements, Mediation, and loan restructuring issues

Seminar is limited to licensed attorneys and paralegals associated with active law firms.
